Luxembourg: producer responsibility without a national sorting panel
Luxembourg requires responsible packaging businesses to participate in the applicable EPR system. It does not prescribe one national on-pack sorting panel for ordinary packaging. Valorlux and Green Dot communications operate through scheme and trademark rules. Harmonised Union labels apply later under the Packaging and Packaging Waste Regulation.
The question this report answers
Luxembourg has comprehensive packaging producer responsibility and no current universal national sorting label. The amended Law of 21 March 2017 applies to packaging placed on the Luxembourg market and assigns obligations to the “responsible for packaging” entity. Current government guidance states that household packaging responsibilities must be transferred contractually to an approved organisation and that Valorlux is presently the approved organisation. The framework now also encompasses non-household packaging through the applicable approved arrangements.
Valorlux collection instructions and the Green Dot are operationally important but are not a statutory material or recyclability label for every package. The Green Dot is a licensed financing symbol governed by contract and trademark rules. Consumers follow Luxembourg collection systems such as the Valorlux blue bag, glass collection and resource centres. The PPWR will later introduce harmonised EU packaging labels. A foreign brand’s pack may therefore generate Luxembourg obligations for an importer or distance seller even though no Luxembourg sorting panel appears on it.

Who is “responsible for packaging”
The national packaging law applies across household, commercial, industrial and service packaging. Government guidance defines the responsible business to include an established person filling or directly selling packaged products in Luxembourg, the first professional recipient of imported packaged products, and certain foreign distance sellers supplying Luxembourg users. Service-packaging producers and importers have a distinct rule. Registration, reporting, financing and prevention obligations apply independently of on-pack marks. Household packaging businesses must use the approved collective route; reusable and non-household packaging follow the options and transfers described in the current government guidance.
The Environment Agency administers packaging producer responsibility and can supervise registration, reporting and approved-system compliance. Those duties exist whether or not a logo appears. A failure to discharge recovery obligations is not the same event as a failure to print a symbol that the law does not require.
Valorlux, the Green Dot, and sorting talk that is not a statute
Valorlux administers collection and recycling arrangements and publishes consumer sorting instructions. Those instructions explain the local collection route but are not, without a separate legal provision, mandatory print elements on every package. Businesses can provide voluntary Luxembourg-specific guidance where it accurately reflects the collection system. Collection in the blue bag is not the same proposition as successful recycling, and EPR membership is not product certification.
The Green Dot is licensed under Valorlux’s membership terms. It indicates financial participation in a packaging recovery system. It does not certify that the marked package is recyclable or belongs in the blue bag. Use without authorisation, alteration of the graphic, or environmental wording that enlarges its meaning creates contractual, trademark and consumer-law risk. Recyclable, reusable, compostable and recycled-content claims must be specific and supportable under Luxembourg and EU consumer law.
The Union labels still to come
The PPWR generally applies from 12 August 2026. Its harmonised material label starts on the later Article 12 date. From 12 February 2027, Article 12(9) confines identification of EPR participation to a digital carrier. That rule is about EPR identification, not a command to treat the Green Dot as a Luxembourg sorting panel that must now be removed, or as a panel that was ever required. Draft EU artwork is not mandatory before the implementing act. How existing Green Dot and voluntary collection communication can coexist with the harmonised system is a Union-transition question, not evidence that Luxembourg already has a national Triman.
