Morocco: a bag ban, proposed EPR, and French files that travel

Current position

Morocco banned specified plastic bags under Law 77-15 from 1 July 2016. Law 28-00 remains the waste framework. An EPR scheme for packaging has been in design for several years and is not an in-force labelling duty. Artwork prepared for France — Triman and Info-tri — often travels on French-language Maghreb files. That mark is a French duty. It does not become a Moroccan mandate by being printed in Casablanca.

The question this report answers

Morocco banned the production, import, export, sale and use of specified plastic bags under Law 77-15, published on 7 December 2015 and applied from 1 July 2016. Law 28-00 remains the waste framework. An EPR scheme for packaging has been in design for several years. None of those instruments, on the record reviewed here, requires a general consumer sorting label on ordinary packaging.

The practical labelling problem in Morocco is often not a missing Moroccan mark. It is a French one. Artwork files prepared for France — Triman, Info-tri, French banned-word rules — circulate on Maghreb SKUs because the language and the brand system are shared. Triman is a French legal object. It does not become a Moroccan duty by being printed in Casablanca, and it does not authorise a recyclability claim that Moroccan law has not defined.

Zero Mika is a ban

Law 77-15 is Morocco’s “Zero Mika” measure: it prohibits specified plastic bags on the domestic market. Controls and fines attach to manufacture, import, commercialisation and use. A national communication campaign accompanied the 2016 commencement. Implementation has been uneven in informal retail, which is a compliance fact, not a repeal. Bags excluded from the ban remain saleable. Those remaining bags have not been shown to carry a statutory recyclability panel.

An EPR-for-packaging design process does not fill that gap until an instrument is made. This report therefore records EPR as proposed. If a later decree requires a producer mark or a sorting panel, that will be a new status, not a back-dated one.

Shared French files

A pack that will also be placed in France must satisfy French law: Triman and Info-tri on household EPR products, and the AGEC word-bans. A pack that will only be placed in Morocco is not bound by those French duties. The collision arises when one physical SKU is intended for both. Printing Triman in Morocco does not make the pack “labelled for Africa”. It makes the pack labelled for France, on a file that happens to travel. The dual-market article now records that pair.
