Peru: a statutory panel on biodegradable bags, not a recycling logo
Supreme Decree No. 025-2021-PRODUCE requires a detailed Spanish panel on biodegradable plastic bags. The duty is product-specific rather than a label for all packaging. Oxo-fragmentable bags that fail the technical regulation are prohibited; a label cannot make them lawful. A June 2025 consultation on the certification route has not produced a new decree. Artwork must still follow in-force Article 6.
The question this report answers
Ley N.° 30884 (El Peruano 19 December 2018) regulates single-use plastic and disposable containers. Article 5.1.b requires a technical regulation and the signals or information that must appear on the bags it covers. Decreto Supremo N.° 025-2021-PRODUCE, published 1 December 2021, is that regulation. It entered into force six months after publication, on 1 June 2022. Article 6 is the labelling article. It is not a recycling logo, not a Möbius loop, and not a duty on bottles, trays or film generally. It applies to persons who manufacture in Peru for domestic consumption, import, distribute or commercialise biodegradable plastic bags in which biodegradable plastic is a significant constituent (at least 1 per cent dry weight).
Resolución Ministerial N.° 000197-2025-PRODUCE, gazetted 4 June 2025, pre-published a draft supreme decree for 90 days of comment because no INACAL-accredited product-certification body existed and the supplier-declaration route had become the de facto rule. No subsequent decree modifying DS 025-2021-PRODUCE was located in El Peruano as of 21 August 2026. The 2025 consultation is not the in-force labelling text.

What Article 6 actually requires on the bag
Article 6.1 requires, in Spanish: (a) the word “BIODEGRADABLE”; (b) the unique number or code of the certificado de conformidad; (c) manufacturer identification (razón social or brand); (d) date of manufacture as month and year; (e) resin type according to NTP-ISO 1043-1:2014 and the 2019 amendment; (f) both of “MINIMICE LA GENERACIÓN DE RESIDUOS” and “NO ABANDONE ESTA BOLSA EN EL AMBIENTE, NECESITA CONDICIONES DE MANEJO ADECUADO PARA SU BIODEGRADACIÓN. LUEGO DE SU USO, SEGREGUE COMO RESIDUO ORGÁNICO”; and (g) where biodegradation conditions are not available in practice and at scale in Peru, “EN NUESTRO PAÍS EXISTE DISPONIBILIDAD LIMITADA DE INFRAESTRUCTURA PARA BIODEGRADAR LAS BOLSAS DE PLÁSTICO.” “In practice and at scale” means authorised residual-waste valorisation infrastructure that actually treats biodegradable plastic, operating in every departamento where the bag will be sold. In current national conditions sentence (g) is the default, not the exception.
Article 6.2: the panel occupies an area not less than 10 per cent of one face, without counting folds or handles, following the referential parameters in Annex II. A 10 per cent calculation that includes handles, or that is split across two faces, fails. Annex II is a drawing aid, not a second size rule. Other languages may appear in addition to Spanish; they do not replace it. There is no digital substitute. The panel is on the bag.
Conformity behind the panel, and the 2025 proposal that did not become a decree
Articles 7–8 sit behind the pack: a certificado de conformidad under NTP-ISO/IEC 17067 schemes, plus a polymer-identification test report, from an OCP accredited by INACAL or an IAF/IAAC member. The first complementary transitional provision still allows a supplier declaration of conformity plus test report (NTP-ISO/IEC 17050) while no INACAL-accredited OCP exists — which is why PRODUCE opened the 2025 consultation. A self-typed “BIODEGRADABLE” with no file behind it is both a labelling and a conformity breach.
Labelling under Article 6 is enforced by INDECOPI (Legislative Decree 1304 Article 4). Technical specifications, certificates and polymer rules are enforced by PRODUCE. A pack can pass one and fail the other. PRODUCE’s non-labelling scale under D. Leg. 1304 Article 10 is a written warning or a fine of 1–500 UIT; that scale is not INDECOPI’s labelling tariff unless a later INDECOPI instrument is produced. Ley 30884 Article 9.2 points product-ban breaches to the General Environmental Law. Oxo-fragmentable bags are prohibited. They are not labelled into the technical regulation.
