Transatlantic recognition: does a European recyclability certificate mean anything in North America?

The equivalence assumption
Global packaging specification often assumes that recyclability, being a matter of polymers and processes, travels across borders even when regulation does not. On that assumption, a package certified recyclable-by-design in Europe is recyclable-by-design in Ohio, because the chemistry is the same. The assumption has commercial consequences. It is only partly true.
The report's finding, as characterised here, is that equivalence obtains partially, by material family, case by case, and not automatically.
Areas of convergence
The report's positive findings cluster where the two systems' underlying processes converge.
Rigid polyolefins — the HDPE and polypropylene containers of household commerce — constitute the aligned zone. The two bodies harmonised core testing parameters: matched filter-pack specifications and screen sequences for compatibility testing, a common ash-content ceiling, and APR's adoption of RecyClass's density threshold for polyolefin separation, alongside recognition of a European laboratory as an APR candidate lab (APR and RecyClass, 2026). For this material family, a test conducted under one body's protocol now approximates the other's, and the report frames mutual recognition of results as achievable.
PET bottles, a globally standardised packaging stream, reached near-alignment. The report describes the bottle protocols as very largely harmonised, with residual divergences at the level of stirring speeds and temperature points, which are differences of laboratory convention rather than of assessment philosophy (APR and RecyClass, 2026).
The pattern of these convergences is consistent: harmonisation succeeded where the recycling processes themselves are internationally uniform, namely wash-and-float reprocessing of rigid containers and bottle-grade PET reclamation. In those cases the assessment target is the same physical system on both continents.
Areas of continuing divergence
The unresolved items follow a corresponding logic.
Flexible packaging — films, pouches and wraps — remained unharmonised. The report attributes this to the fact that the two continents' collection and sorting infrastructures for flexibles differ so fundamentally that no common assessment target exists (APR and RecyClass, 2026). Europe assesses films against dedicated collection and emerging mechanical streams, whereas the North American position for flexibles is store drop-off and general exclusion from kerbside collection. A design-for-recycling determination on a pouch is accordingly a determination about a system; where the systems diverge, harmonisation of the protocol alone would produce an equivalence that the underlying systems do not support.
Inks, adhesives and additives produced persistent methodological disagreement. The report records unresolved divergence on ink classification, distinguishing washable from non-deinkable categories, on adhesive evaluation methodology, and on additive impact assessment (APR and RecyClass, 2026). These are the components that design decisions most often adjust, so the divergence bears directly on the practical use of either system's determinations.
The report further records that the parties did not achieve their stated objective of common recyclability protocols, citing sharply limited value-chain participation in the joint testing that harmonisation required, and that reciprocal certification accordingly remains case-by-case (APR and RecyClass, 2026). Firms declined, in numbers the report treats as material, to fund duplicate testing whose benefit was systemic rather than proprietary. That pattern corresponds to what economic analysis describes as a collective-action problem arising within a technical project.
The cooperation report at parameter level
Because the cooperation report is the primary record of the harmonisation effort, its concrete harmonisations warrant enumeration beyond the summary level, since they indicate what technical convergence consists of where it is achieved.
For the rigid polyolefin protocols, the two bodies aligned the mechanics of compatibility testing: agreement on filter-pack construction and on the graduated screen sequence through which contaminated melt is evaluated, a common ash-content ceiling for acceptable residue, and unified specimen and washing parameters. This is apparatus-level identity, which is what renders one laboratory's result legible to the other system (APR and RecyClass, 2026). The density threshold is an instance of a unilateral concession: APR adopted RecyClass's maximum density for polyolefin flotation separation, accepting the European parameter and thereby closing a divergence under which identical packages could be sortable in one system's test and not in the other's. Institutional arrangements followed the parameters. A European testing laboratory achieved APR candidate-laboratory status, which opens a route by which European test data may enter American recognition without re-testing (APR and RecyClass, 2026).
The PET bottle residuals are equally concrete in the opposite direction. With the protocols described as "very much aligned", the remaining differences concern stirring speed and temperature points (APR and RecyClass, 2026). One explanation for the persistence of such small differences is that each body's archive of past results is calibrated to its own numbers, so that the final increments of convergence would be paid for in lost comparability with a system's own historical data. That explanation is offered here as an inference and is not stated by the report.
The enumeration bears on the analysis of the failure that follows. Harmonisation succeeded where it could be executed inside the laboratories, in apparatus, thresholds and accreditation, and stalled where it required convergence outside them: collection systems for flexibles, commercial ink and adhesive practices, and the value chain's willingness to fund testing without proprietary return. On the report's record, technical alignment did not extend to the economies being assessed.
Structural constraints on equivalence
The report's pattern supports three propositions, each advanced here as interpretation of the record rather than as a finding of the report.
First, recyclability assessment is a form of infrastructure assessment. The chemistry-is-chemistry intuition fails because design-for-recycling determinations concern polymers as processed by particular machinery — the specific screens, washes, float tanks and optical sorters of a continent's installed base — rather than polymers in the abstract. Where installations converge, as with PET bottles, determinations converge; where they diverge, as with flexibles, protocol drafting cannot bridge them. The same locality that constrains global disposal labels therefore reappears at the level of technical assessment.
Second, governance reflects the industry it serves. APR's categories emerge from committees with mandated reclaimer seats, whereas RecyClass operates under Europe's recycler federation with its associated certification-body network. Each system's classifications encode the operating economics of its own industry, namely what its reclaimers can tolerate, so harmonisation asks each body to import the other's cost structure. On this reading, the disputes over inks and adhesives are, beneath their methodological form, disputes about whose reprocessing losses are counted.
Third, voluntary harmonisation lacks a forcing mechanism. Standards alignment has the characteristics of a public good, whereas testing is a private cost. The report's own diagnosis of insufficient value-chain participation is consistent with that characterisation. Absent regulation compelling convergence, or a market actor internalising the benefit, transatlantic equivalence remains where the May 2026 report leaves it.
The semantics of a certificate across jurisdictions
The consequences for the interpretation of a certificate or claim follow from the foregoing.
A RecyClass design grade asserts compatibility with European reference processes assessed against European guidelines, whereas an APR recognition asserts performance under North American protocols assessed against the APR guide. Neither transfers by right. For rigid polyolefins and PET bottles, the harmonised parameters mean that a certificate's underlying test data will likely be reusable across the two bodies; recognition, however, remains a decision taken certificate by certificate rather than an entitlement (APR and RecyClass, 2026). For flexibles, laminates and chemistry-intensive constructions, a certificate issued on one continent asserts nothing about the other.
The corollary for claims law is that recyclability claims substantiated by foreign assessment inherit the mismatch. An EU-certified design grade does not substantiate a "recyclable" claim under US doctrine, which addresses access and processing where the item is sold; the Green Guides' substantial-majority test and California's criteria are geographic in construction. The transatlantic gap is therefore evidentiary as well as technical, in that the certificate answers a different jurisdiction's question.
Comparison with other harmonisation efforts
The cooperation report's mixed result acquires definition when set beside harmonisation efforts in adjacent fields, because the comparison isolates the features that make recyclability assessment difficult to align.
Compostability achieved earlier and deeper transatlantic convergence than recyclability has. The EN and ASTM specification families share their architecture, including conversion thresholds, disintegration limits and ecotoxicity requirements, and certifiers bridge them routinely, with bodies certifying to both continents' standards from a single laboratory campaign. The difference lies in the assessment target: compostability standards test the material against a controlled process, specified as 58 degrees, a defined duration and a specified inoculum, and a controlled process can be specified identically in any location. Recyclability assessment, by contrast, tests the package against an installed industry, and installed industries are not harmonised by committee. Where the compostability comparison does break down, in the order-of-magnitude divergence between the two continents' heavy-metal limits, it breaks on a dimension that is a policy choice rather than a process fact, which is consistent with the same explanation approached from the opposite direction.
The identification layer offers a second contrast. The barcode achieved effectively global harmonisation, and its successor syntax is following, because identification is the limiting case of context-independence: an identifier asserts nothing about locality. Arrayed along this spectrum, the assessment families may be ordered by how much place their assertions contain. Identification, containing none, harmonises completely; compostability, resting on a standardisable process, harmonises structurally while retaining policy divergences; design-for-recycling, resting on a continent's installed processes, harmonises by material family, as the report found; and recyclability-in-practice, the "recycled at scale" dimension the EU is now legislating, harmonises least, since it consists of nothing but place.
The spectrum supports a reading of the report on which APR and RecyClass did not fail at a task their counterparts in adjacent fields accomplished, but converged to the depth their subject matter permits and documented the boundary. Regulatory hardening of the assessment layer
Both continents are hardening their assessment layers into law, the EU through its 2030–2038 recyclability-grade market-access regime and the US through state claims statutes anchored to APR conformity. The hardening has effects in both directions for equivalence. It raises the consequences of divergence, since when grades gate markets, transatlantic misalignment becomes a trade friction of the kind WTO practice has long debated in relation to environmental labeling. It may equally supply the forcing mechanism that voluntarism lacked, in that regulatory methodologies, once fixed in delegated acts and statutory criteria, create compliance markets large enough to fund the joint testing the 2026 effort could not, and give both bodies a shared external reference that neither controls.
On that basis the May 2026 report may be read as a baseline rather than a conclusion: a documented statement of how far packaging recyclability assessment travels — extensively for rigid containers, further for bottles, not at all for flexibles, and contested for chemistry — before the period of mandatory grades begins. The recurring proposition across this theme is that a recyclability determination, however technical its expression, is a statement about a particular system in a particular place.
Conditions for full equivalence
The cooperation record permits a specification of what transatlantic recognition would require, which serves both as a benchmark for future announcements and as a measure of the distance between that benchmark and the current instruments.
Full equivalence would require three alignments that the 2026 report documents as absent. Methodological alignment would require the two bodies' test protocols, sample preparations and pass criteria to converge or be formally mapped, category by category; this was achieved most nearly for bottles and was not attempted for flexibles. Infrastructural alignment is the more demanding condition, because both systems' determinations are calibrated to their own continent's collection, sortation and reprocessing base, so that equivalence of determinations presupposes comparability of systems, which protocol harmonisation cannot supply where materials-recovery-facility economics differ. Institutional alignment is the condition neither body controls: once the EU's delegated acts fix recyclability grades in law, equivalence becomes a regulatory determination, negotiable through the mutual-recognition machinery of trade policy rather than through the technical committees in which the current cooperation is conducted.
Future claims of mutual recognition between the two systems may be assessed against those three alignments. A joint protocol constitutes methodological progress; a shared determination about a package family constitutes infrastructural progress only where the underlying systems have converged; and recognition in the sense that governs market access requires regulatory instruments naming each other. Measured against that standard, the transatlantic project is at the first of the three stages, which the 2026 report itself records.
