Czechia: material coding that is standardised, not required
Czechia does not require material identification on every package. Where a person placing packaging on the market chooses to identify the material, section 6 of the Packaging Act requires that identification to follow European Union law. Returnable deposit packaging has targeted marking rules of its own. The Green Dot and EKO-KOM symbols are licensed participation marks. Harmonised Union sorting labels apply later under the Packaging and Packaging Waste Regulation.
The question this report answers
Czechia is frequently misclassified because older guidance and secondary summaries describe material identification as mandatory. The current text of section 6 of Act No. 477/2001 on Packaging is conditional. If the person placing packaging on the market or into circulation identifies the material, that identification must comply with European Union law. The Act does not impose a general duty to identify every ordinary package. The “if” is the whole of the provision’s meaning for labelling.
Other duties remain binding and should not be folded into that optional code. Producers and importers must satisfy packaging prevention, take-back, recovery and registration requirements, directly or through an authorised packaging company such as EKO-KOM. Returnable deposit packaging has targeted marking rules under Decree No. 116/2002. The Green Dot and the EKO-KOM symbol communicate financing through the authorised recovery system. They are not proof of recyclability. Regulation (EU) 2025/40 adds a future harmonised labelling layer on its own timetable.

The optional code that still has a prescribed form
Section 6 controls the form of a voluntary choice. When a business marks the package material, it must use the EU identification system, including the relevant numbers and abbreviations. Czechia can therefore maintain standardised material information without requiring a code on every package. A material code identifies composition. It does not establish that municipal collection accepts the item, or that the item is recycled at scale. Voluntary sorting text is a separate representation, to be read against Czech collection conditions and the pack’s complete component structure.
EPR, the Green Dot, and EKO-KOM
The Packaging Act places take-back and recovery obligations on persons placing packaging on the Czech market or into circulation. Many businesses discharge those duties through EKO-KOM, the authorised packaging company. System membership, reporting and fees are compliance activities independent of whether the package displays a mark. EKO-KOM licenses the Green Dot and its own trademark to eligible clients. Both marks communicate payment into a recovery organisation. They do not classify the material, and they should not be presented as a consumer sorting instruction. A Czech licence does not automatically authorise use of the same trademark in another market.
The relevant person is the entity placing packaging on the market or into circulation, which can include a domestic filler, importer or distributor depending on the transaction. EKO-KOM participation can transfer specified recovery obligations within the statutory scheme. It does not transfer responsibility for inaccurate consumer claims made by the brand or seller. The Ministry of the Environment and the Czech Environmental Inspectorate administer and enforce the packaging framework. The Packaging Act contains substantial administrative penalties for specified breaches. There is no universal fine for omitting an optional material code. Enforcement analysis has to identify the actual duty breached.
Returnable packaging, and the Union labels still to come
Returnable deposit packaging is governed by targeted national rules, including Decree No. 116/2002. The prescribed identifier, deposit arrangements and reuse infrastructure belong to that system. They are distinct from optional material coding for ordinary non-returnable packaging. Treating a deposit identifier as a general Czech recycling label is the same error, in reverse, as treating section 6 as a universal coding duty.
The PPWR material-composition label applies from the later of 12 August 2028 and 24 months after the relevant implementing act. Reusable-packaging labelling follows later. From 12 February 2027, Article 12(9) confines identification of EPR participation to a digital carrier. Existing Czech voluntary codes and trademarks will have to be reviewed for consistency, and for possible consumer confusion, once harmonised Union labels are established. Those dates are not a 2026 Czech sorting mandate.
