PFAS and compostability certification: how did fluorine limits get inside the seal?

Introduction

PFAS entered food packaging as grease-proofing agents. They entered packaging governance through compostability certification, not through chemicals law. Since 2020 the operative PFAS limit for a substantial share of North American food-service packaging has been a condition of a private compostability seal.

The pathway into compostability certification

The pathway is explicable by reference to the compost system's exposure. Compostable food packaging exists in order to travel with food waste into organics processing; whatever the packaging carries, the compost carries; and whatever the compost carries is applied to soil, whether on farms, in gardens or in landscaping. PFAS are persistent by design and mobile in soil and water, and composting neither destroys nor immobilises them. Fluorinated packaging bearing a compostable claim therefore converts a waste-diversion pathway into a pathway for diffuse soil contamination. Composters and their customers, organic growers in particular, were the parties first exposed to that risk, and certification was the instrument available to them.

The chemistry of grease-proofing supplied a second premise. Fluorinated coatings were common in precisely the moulded-fibre and paper food-service formats that account for much compostable packaging, so that the overlap between products that were certified compostable and products that were intentionally fluorinated was, at the regime's inception, substantial. A screen applied at the point of certification therefore reached a large proportion of the affected products.

The BPI regime

The Biodegradable Products Institute acted first, and its scheme remains the template for the requirement. Since 1 January 2020, BPI certification has required that products contain no intentionally added fluorinated chemicals and that total organic fluorine not exceed 100 parts per million; products unable to meet the requirement were delisted at the end of 2019 (BPI, n.d.). The compliance machinery is correspondingly detailed: certification requires safety data sheets for all ingredients, laboratory results for total organic fluorine from approved laboratories, and a signed declaration that no fluorinated chemicals were intentionally added (BPI, n.d.).

Two design choices determine the regime's character. The metric, total organic fluorine, operates as a screen rather than as a substance list. Instead of enumerating individual PFAS, which form a family of thousands of compounds capable of being reformulated more rapidly than any list can be maintained, the test measures organically bound fluorine in aggregate and thereby identifies the family through its shared element. The 100 ppm threshold is in turn set at a level that distinguishes intentional fluorination from background and incidental contamination: intentionally grease-proofed fibre exceeds it substantially, whereas unfluorinated products carrying trace contamination generally fall below it. The design accordingly trades chemical precision for resistance to evasion, which is a characteristic trade-off of governance administered at certification scale.

The Californian codification

California converted the private rule into public law. Under the state's compostable-labeling statute, AB 1201, which amends the Public Resources Code, a product may be labelled "compostable" only if, among other conditions, it meets the ASTM specifications, holds certification from an approved third party, satisfies visual-distinguishability rules, and contains total organic fluorine below 100 ppm (CalRecycle, n.d.; AB 1201, 2021). The statutory scheme aligns with the BPI regime in both metric and threshold, and it adds a further requirement with a deferred commencement: compostable products must ultimately comply with federal organic-input requirements under the USDA National Organic Program, a requirement taking effect from 30 June 2027 with provision for extension in defined cases (CalRecycle, n.d.).

The codification completes an inversion of the usual division of regulatory functions. In the ordinary architecture, chemical regulation restricts substances and labeling law polices claims, and the two operate separately. Here they are fused, in that the fluorine test forms an element of the claim's legal definition in California. A compostable cup compliant in every other respect but failing the fluorine screen is therefore not merely uncertifiable but unlabelable, because the use of the word is itself statutorily conditioned on the chemistry.

Scope and limitations

Precision about scope avoids two opposite errors, namely treating the fluorine screen as either less or more than it is.

The screen is more than a labeling formality. The 100 ppm requirement, enforced through delisting and through statutory labeling bars, is understood in sector coverage to have driven intentional fluorination out of the certified compostable packaging market in North America, grease-proofing having been reformulated because the seal, and subsequently the statute, foreclosed the alternative. It thereby constitutes an instance of labeling governance producing an outcome ordinarily sought through chemicals policy.

The screen is, at the same time, less than a general PFAS regime. It binds only where the seal or the statute reaches, namely to certified compostables and to California-labelled compostables. Non-compostable food packaging, unlabelled packaging, and markets that have not incorporated the limit sit outside it, governed, if at all, by the patchwork of state food-packaging PFAS bans and evolving federal action that lies beyond this article's scope. Nor does the screen address PFAS already present in compost feedstocks from other sources; it closes one entry route rather than the system as a whole.

The metric also has recognised edges. Total organic fluorine is over-inclusive in principle, in that it captures non-PFAS organofluorines, and it is threshold-dependent in practice. The 100 ppm line is a governance judgment rather than a toxicological derivation, and jurisdictions considering lower thresholds or formulations based on the absence of intentional addition are considering where the trade-offs inherent in screen design should sit.

The certifier as administrator of a chemical requirement

The episode illustrates a pattern observable across the themes examined in this collection, in which certification marks operate as the enforcement layer for requirements that public law seeks but cannot administer at comparable cost.

The functions the fluorine regime requires of its administrator amount to a full conformity-assessment apparatus: specifying test methods, approving laboratories, collecting ingredient declarations, conducting surveillance and delisting non-conforming products. A state environmental agency constructing that apparatus for one parameter of one product class would face an extended rule-making process, whereas BPI, holding contractual power over its own mark, imposed the requirement by amending scheme rules with a one-year transition. California then achieved statutory coverage by reference, incorporating the certification architecture rather than duplicating it. Comparable patterns appear elsewhere in this collection, including design-for-recycling grades entering EU market-access law and third-party certification operating as the lawful gate for EU sustainability labels. In the present case the sequence was that the private seal established the requirement first and the statute subsequently adopted it.

The pattern's costs accompany its efficiencies. Scheme rules are made by member-funded bodies that are not subject to administrative-procedure obligations; thresholds set for one continent's certification become another jurisdiction's law by citation; and the mark's dual role as marketing asset and compliance instrument creates a standing tension the certifier must manage. In this instance the founding constituency for the requirement was the receiving side of the system, comprising composters and growers, rather than the packaging producers whose products the requirement constrains.

The regime in comparative context

Setting the North American fluorine screen against adjacent regimes clarifies both its novelty and its limits.

The European compostability framework reaches fluorine by an older route: EN 13432's constituent-control requirements include fluorine within the schedule of limited elements alongside the heavy metals (Vinçotte, n.d.). Fluorine is thereby treated as a compost-quality parameter of the same family as cadmium and lead, set for the protection of soil generally rather than as a targeted PFAS instrument. The North American development consisted not in identifying fluorine as a parameter but in converting an element limit into a screen for intentional fluorination, with the declaration-and-testing machinery and the delisting sanction that make it operable as a chemicals-policy instrument. The two regimes accordingly answer different questions: EN 13432 asks whether the compost's elemental load is acceptable, whereas the BPI and California screen asks whether the product's grease-proofing strategy was fluorochemical. A formulation could in principle satisfy the first while failing the second.

The screen's relationship to general food-packaging PFAS law completes the comparison. The state bans on intentionally added PFAS in food packaging that have proliferated across US jurisdictions operate on the product-safety track: they bind regardless of any environmental claim, and their metric, being intentional addition, sometimes with screening thresholds, parallels the certification regime's design. The compostability screen's distinguishing features are its timing and its enforcement channel: it arrived earlier than most bans, and it operates through certification and labeling eligibility, which requires no inspectorate because compliance is policed through the market's reliance on the seal. Where both instruments apply, the certification screen typically constitutes the stricter operational test; where only the safety bans apply, fluorinated packaging may persist lawfully provided that no compostable claim is made, and that boundary defines both the regime's reach and the agenda of those who consider it insufficient.

For the systems downstream of the package, the convergence of the two regimes is of greater practical consequence than their differing mechanics: composters and organics regulators in both regions now operate behind at least one fluorine gate, and the compost-contamination pathway that certified packaging formerly represented has been substantially closed at the certification step.

Chronology and the accretion of requirements

The regime's chronology is instructive for the general pattern it exhibits, since its three operative dates, being 1 January 2020, the 2021 statute and 30 June 2027, trace a sequence of successive tightening.

The first date marks a private and rapid change. BPI's fluorine requirement took effect with a one-year runway and a defined consequence, in that products unable to comply were delisted at the end of 2019 (BPI, n.d.). There was no public comment period and no legislative bargaining, the timescale being that available to a mark owner amending its own licence terms. The second date marks a public adoption of the resulting rule: California's 2021 statute did not negotiate a new threshold but adopted the incumbent one, converting a certification condition into an element of lawful commercial speech (AB 1201, 2021; CalRecycle, n.d.). The interval between the two dates, of roughly two years, indicates the speed at which a legislature can act where a private regime has already absorbed the technical work and the costs of industry adjustment.

The third date extends the sequence. The federal organic-input requirement taking effect from 30 June 2027, with provision for extension in defined cases (CalRecycle, n.d.), raises the applicable standard again, from a single-element screen to conformity with an entire agricultural-inputs framework, and does so once more by reference to a regime constructed elsewhere, in this instance the USDA National Organic Program. Each step incorporates an existing apparatus, and each step increases the conditions attached to the compostable label. The word's legal content in California has accordingly moved, within a decade, from a decomposition claim to a decomposition-plus-chemistry claim and, prospectively, to a decomposition-plus-chemistry-plus-agricultural-suitability claim.

The direction of that sequence is consistent with the incentives of the parties involved. Because the label's function is to admit packaging into a food-soil pathway, every constituency downstream of the compost pile, comprising processors, growers and organic certifiers, holds a continuing incentive to press further conditions into the seal, and no constituency holds a corresponding incentive to relax it. On that analysis, which is an inference from the structure of the incentives rather than a proposition asserted by any source cited here, labels operating as gateways to sensitive systems may be expected to accumulate requirements over time, and the fluorine screen represents the first step in that process rather than its conclusion.

The mark's chemical assertion and its limits

After 2020, a BPI seal, and after 2021 a lawful California "compostable" label, carries a chemical representation that consumers are unlikely to identify as such: that the item was screened for organic fluorine below 100 ppm, with no intentionally added fluorinated chemistry declared. That assertion is testable and enforced through the delisting and labeling mechanisms described above.

The mark's limits are correspondingly definite. It does not certify the item PFAS-free, since 100 ppm is a screen against intentional fluorination rather than a zero threshold. It does not certify the compost produced by any facility as uncontaminated, that question being dominated by feedstocks the mark never reaches. It does not extend to packaging outside the certified universe, in which fluorinated grease-proofing may lawfully persist under whatever chemical rules apply locally. Furthermore, compostability marks in other regions may carry no fluorine screen at all: European certification addresses fluorine through EN 13432's constituent limits on a different basis (Vinçotte, n.d.), and the 100 ppm architecture of the North American regime is not a global norm.

The PFAS episode consequently modifies the compostability seal's content in a direction opposite to the dilution documented for other marks in this theme. The seal originated as a claim about decomposition; the fluorine regime made it additionally a claim about composition, the requirement having been added because the systems downstream of the package required it.
